1-3-2: DEFINITIONS, GENERAL:
Whenever the following words or terms are used in this Code, they shall have such meanings herein ascribed to them, unless the context makes such meaning repugnant thereto:
AGENT: A person acting on behalf of another with either actual or apparent authority to bind another by his acts.
AND, OR: "And" may be read "or" and "or" may be read "and" if the sense requires it.
BOND: An obligation, in writing, binding the signatory to pay a sum certain upon the happening or failure of an event.
BUILDING: Any structure intended to have walls and a roof.
CITY LIMITS OR CORPORATE LIMITS: Within the City and includes not only the corporate limits of the City but also any property which the City owns or which is under its jurisdiction.
CITY, TOWN, VILLAGE, MUNICIPAL CORPORATION OR MUNICIPALITY: Denotes the City of Northlake, irrespective of its population or legal classification.
CLERK: The City Clerk.
CODE: The Municipal Code of the City of Northlake.
COUNCIL: The City Council, Aldermen and Mayor.
COUNTY: Cook County, Illinois.
EMPLOYEES: Whenever reference is made in this Code to a City employee by title only, this shall be construed as though followed by the words "of the City of Northlake".
FEE: A sum of money charged by the City for the carrying on of a business, profession or occupation.
FISCAL YEAR: The fiscal year of the City shall commence on January 1 of each year and end on December 31 of the same year 1 .
JOINT AUTHORITY: That authority given to several persons or officers. Such authority vests in a majority of such persons or officers.
LICENSE: The permission granted for the carrying on of a business, profession or occupation.
MAY: The word may is permissive and discretionary.
MAYOR: The Mayor of the City.
MISDEMEANOR: Any offense for which a sentence to a term of imprisonment in other than a penitentiary for less than one year may be imposed.
MONTH: A calendar month.
NUISANCE: Anything offensive or obnoxious to the health and welfare of the inhabitants of the City; or any act or thing repugnant to, or creating a hazard to, or having a detrimental effect on the property of another person or to the community.
OATH: Any form of attestation by which a person signifies that he is bound in conscience to perform an act or to speak faithfully and truthfully, and shall include an affirmation or declaration in cases where by law an affirmation may be substituted for an oath.
OCCUPANT: As applied to a building or land, shall include any person who occupies the whole or any part of such building or land whether alone or with others.
OFFENSE: Any act forbidden by any provision of this Code, State law or Federal law or the omission of any act required by the provisions of this Code.
OFFICERS: Whenever reference is made in this Code to a City officer by title only, this shall be construed as though followed by the words "of the City of Northlake".
OFFICES: Reference to a public office or officer shall be deemed to apply to any office, officer or employee of the City exercising the powers, duties or functions contemplated in the provision, irrespective of any transfer of functions or change in the official title of the functionary.
OFFICIAL TIME: The official time within the City for the transaction of all City business shall be as follows:
Monday, Tuesday, Wednesday, Thursday and Friday, nine o'clock (9:00) A.M. to five o'clock (5:00) P.M.
Saturday, nine o'clock (9:00) A.M. to twelve o'clock (12:00) noon.
OPERATOR: The person who is in charge of any operation, business or profession.
OWNER: A person who has complete dominion over a particular property and who is the one in whom legal or equitable title rests; when applied to a building or land, owner shall mean any part owner, joint owner, owner of a community or partnership interest, life tenant, tenant in common or joint tenant of the whole or part of such building or land.
PERSON: Any individual, natural person, joint stock company, partnership, voluntary association, society, club, firm, company, corporation, business trust, organization or any other group acting as a unit, or the manager, lessee, agent, servant, partner, member, director, officer or employee of any of them, including an executor, administrator, trustee, receiver or other representative appointed according to law. Whenever used in any clause prescribing and imposing a penalty, the term person or whoever, as applied to any unincorporated entity, shall mean the partners or members thereof and as applied to corporations, the officers thereof.
PERSONAL PROPERTY: Any money, goods, movable chattels, things in action, evidence of debt, all objects and rights which are capable of ownership and every other species of property except real property.
PRECEDING AND FOLLOWING: Next before and next after, respectively.
PROPERTY: Includes real and personal property.
PUBLIC PLACE: Means and includes any public street, road or highway, alley, lane, sidewalk, crosswalk or other public way or any public resort, place of amusement, stadium, athletic field, park, playground, public building or grounds appurtenant thereto, school building or school grounds, public parking lot or any vacant lot, the elevator, lobby, halls, corridors and areas open to the public of any store, office or apartment building or any other place commonly open to the public.
REAL PROPERTY: Land, together with all things attached to the land so as to become a part thereof.
RETAILER: Unless otherwise specifically defined, shall be understood to relate to the sale of goods, merchandise, articles or things in small quantities direct to the consumer.
RIGHT OF WAY: The privilege of the immediate use of the roadway or other property.
SHALL: The word shall is mandatory.
SIDEWALK: That portion of a street between the curb line and the adjacent property along the margin of a street or other highway designed, constructed and intended for the use of pedestrians to the exclusion of vehicles.
SIGNATURE AND SUBSCRIPTION: The name of a person or the mark or symbol appended by him to a writing with intent to authenticate the instrument as one made or put into effect by him.
STATE: The State of Illinois.
STREET: All streets, highways, avenues, boulevards, parkways, roads, lanes, viaducts, bridges and the approaches thereto, docks built on the public street, alleys, courts, places, squares, curbs, sidewalks, recreation and park lands used for vehicular traffic or other public ways or thoroughfares in this City over which it has jurisdiction which have been or may hereafter be dedicated and open to public use, or such other public property so designated by any law of this State.
STRUCTURE: Anything constructed or erected which requires location on the ground or is attached to something having location on the ground including a fence or freestanding wall. A sign, billboard or other advertising medium, detached or projecting, shall be construed to be a structure.
TENANT, OCCUPANT: The words "tenant" and "occupant", applied to a building or land, shall include any person who occupies the whole or part of such building or land, whether alone or with others.
TIME: An hour of the day according to the official time of the City.
WEEK: Seven (7) days; however, publication in a newspaper or other required paper of any notice or other matter indicated to be for a stated number of weeks shall be construed to mean one insertion in each week, unless specifically stated to be for each day of the week or for more than one day in each week.
WHOLESALER: The terms "wholesaler" and "wholesale dealer" as used in this Code, unless otherwise specifically defined, shall be understood to relate to the sale of goods, merchandise, articles or things in quantity to persons who purchase for the purpose of resale.
WRITTEN, IN WRITING: May include printing and any other mode of representing words and letters, but when the written signature of any person is required by law to any official or public writing or bond it shall be in the proper handwriting of such person, or in case he is unable to write, by his proper mark.
