A. Species Enumerated: The following listed trees shall not be planted on City parkways because of commonly acknowledged high maintenance and undesirable characteristics (e.g. brittle wood, cavity prone, excessive deadwood, disease susceptible, etc.) associated with the use of these species in the urban environment:

All types of fruit trees producing fruit typically for human consumption.
B. Existing Prohibited Species:
1. Where the above-listed trees have been planted and are growing on City parkways, they shall gradually be removed through normal attrition and replaced with approved trees.
2. The Director of Public Works has the option of excluding the "undesirable tree" description as a reason for removal when, in his professional opinion, a particular contested specimen(s) of the listed undesirable species exhibits redeeming characteristics typical of a desirable species but uncharacteristic for the contested specimen's species.
C. Diseased, Deformed, Dangerous Trees:
1. All crippled, deformed and physically damaged trees, whether on City parkways or private property, regardless of species, if professional opinion indicates recovery and normal development cannot be expected, may be considered for removal and replacement. All such trees on private property shall be removed and replaced at the expense of the owner of the property.
2. All trees infected with noncurable disease that will result in (1) deformation, (2) death and (3) infection of other trees, whether on City parkways or private property, shall be removed and replaced, if warranted. All such trees on private property shall be removed or replaced at the expense of the owner of the property.
3. All trees whose condition and/or location is determined to present a serious present or future potential for endangering life or property, whether on City parkways or private property, shall be removed and replaced as warranted. All such trees on private property shall be removed at the expense of the owner of the property and replaced. (Ord. 0-28-90, 6-4-90; amd. Ord. O-20-2021, 12-20-2021)
