3-5-1: DEFINITIONS:
For the purposes of this chapter, the following terms shall have the following meanings:
APPLICANT: Any person or entity that has filed an application for a commercial solicitation permit as hereinafter provided.
CHARITABLE ORGANIZATION: As that same term is defined in 225 Illinois Compiled Statutes 460/1, or a not for profit organization incorporated pursuant to 805 Illinois Compiled Statutes 110/0.01 and 110/35, or any other organization that has been granted tax exempt status from the state of Illinois or the internal revenue service.
CHARITABLE PURPOSE: Charitable purposes as that same term is defined in 225 Illinois Compiled Statutes 460/1, and as that term is construed by the Illinois courts under such statute. For the purpose of this chapter, solicitation for a charitable purpose shall include solicitation for or on behalf of a "charitable organization", as that term is defined herein.
CHIEF OF POLICE: The chief of police of the city of Northlake or his designee.
COMMERCIAL SOLICITATION: Seeking to sell, offer for sale, sell and deliver, barter, exchange, or obtain, for profit or any kind of consideration whatever; gifts; contributions of money; and orders for the purchase of goods, wares, merchandise, foodstuffs, services of any kind, character or description, insurance, books, magazines, periodicals, newspapers, and every other type of publication or subscriptions therefor; or distribution to the public, by leaving the same at stores, offices, residences or on public property in the city any paper, document or article of a commercial nature including, but not limited to, cards, circulars, handbills, samples, merchandise or any advertising matter whatsoever; except when the same is conducted for any charitable purpose, religious purpose, or political purpose, or on behalf of any charitable organization.
NONRESIDENTIAL PREMISES: Means and includes all buildings, structures, and units in the city occupied for nonresidential purposes.
POLITICAL PURPOSE: Any activity in support of bona fide candidates for public office, or any matter related to the election, nomination, or performance of public officials, or issues presented to the electorate of any election.
REGISTERED SOLICITOR: Means and includes any person who has obtained a valid commercial solicitation permit as hereinafter provided.
RESIDENCE: Means and includes every separate living unit in the city occupied for residential purposes by one or more persons, contained within any type of building or structure.
SOLICITATION: Includes any one or more of the following activities:
   A.   Seeking to obtain orders for the purchase of goods, wares, merchandise, foodstuffs, services of any kind, character or description whatever, for any kind of consideration whatever.
   B.   Seeking to obtain prospective customers for application or purchase of insurance of any type, kind or character.
   C.   Seeking to obtain subscriptions to books, magazines, periodicals, newspapers and every other type or kind of publication.
   D.   Seeking to obtain gifts or contributions of money, clothing or any other valuable thing for the support or benefit of any commercial, charitable, nonprofit or political purpose.
   E.   Distributing pamphlets, handouts or any other material or seeking signatures in support of any commercial, charitable, nonprofit or political purpose.
"Solicitation" does not include the actions of any federal, state, local government employee or public utility employee performing duties for his or her employer. (Ord. O-21-2009, 7-6-2009)
