The following checklist of procedures shall be followed by the applicable department supervisor for the contracting of goods and services for the Village of North Kingsville:
(a) Have the contracting party complete a “Delinquent Personal Property Tax Affidavit” and provide proof of current Worker’s Compensation insurance coverage unless the contractor is self employed and completing all contracted work with labor accomplished only by the contractor.
(b) If the contracting party submits their own agreement for the Village to enter, the department supervisor shall attach the “Delinquent Personal Property Tax Affidavit” and proof of current Worker’s Compensation insurance coverage to the agreement and submit the agreement to the Law, Ordinance & Health Committee for review prior to approval by Council and signing.
(c) If the contracting party does not submit their own agreement for the Village to enter, the department supervisor shall determine which of the two form agreements, “Labor & Material” or “Percentage of Completion” should be utilized.
(d) If the contracting party does not submit their own agreement for the Village to enter, the department supervisor shall enter all of the information necessary to complete the Village form agreement, attach the “Delinquent Personal Property Tax Affidavit” and proof of current Worker’s Compensation insurance coverage to the agreement; and, submit the agreement to the Law, Ordinance & Health Committee for review prior to approval by Council and signing.
(e) Upon receipt of an agreement by the Law, Ordinance & Health Committee, the agreement will be either returned to the department supervisor for revisions or scheduled for presentation to Council by resolution.
(f) Upon the Law, Ordinance & Health Committee placing the agreement and resolution before Council, Council shall either:
(1) Approve the agreement and authorize the Mayor and clerk-Treasurer to sign said agreement,
(2) Approve the agreement with specified changes and authorize the Mayor and Clerk-Treasurer to sign said agreement, or
(3) Disapprove the Village from entering into the agreement.
(g) After the passage of a resolution approving an agreement for the Village, the Mayor and Clerk-Treasurer shall sign duplicate original agreements and submit the agreements to the contracting party for signature.
(h) After both agreements have been signed by all parties, one duplicate original shall be retained by the contracting party and one duplicate original shall be kept by the Clerk-Treasurer for the records of the Village.
(i) The Clerk-Treasurer shall transmit the “Delinquent Personal Property Tax Affidavit” to the County Treasurer within 30 days of the date the agreement is signed and returned to the Village.
