Sections 1343.05 to 1343.09 shall not apply to a family or private swimming pool intended solely for persons of the immediate family and nonpaying guests, and where such pool is maintained on the premises of the home owner or on premises adjacent to any one of a group operating a private pool. This chapter shall not apply to a portable pool of plastic or rubber construction.
