1113.04 VARIANCES.
   The following regulations shall govern the granting of variances:
   (a)    Where the Planning Commission finds that extraordinary and unnecessary hardship may result from strict compliance with these Subdivision Regulations, due to exceptional topographic or other physical conditions, it may vary these Subdivision Regulations so as to relieve such hardship, provided that such relief may be granted without detriment to the public interest and without impairing the intent and purpose of these Subdivision Regulations or the desirable development of the neighborhood and community. Such variations shall not have the effect of nullifying the intent and purpose of these Subdivision Regulations, the Comprehensive Development Plan or the Zoning Code.
   (b)    In granting variances or modifications, the Commission may require such conditions as will, in its judgement, substantially secure the objective of the standard or requirement so varied or modified.
   (c)    An application for a subdivision variance shall be filed on Form 906, which Form is set forth in Appendix A following the text of these Subdivision Regulations.
