951.05 RULES AND REGULATIONS FOR HAULERS.
   (a)    The issuance of a license to haul refuse, garbage, rubbish or solid waste in the Village, or to park a motor vehicle used in hauling refuse, garbage, rubbish or solid waste in the Village, shall be contingent upon compliance with the rules and regulations set forth in this section.
   (b)    Any motor vehicle used for hauling refuse, garbage, rubbish or solid waste in the Village shall satisfy all requirements of the Traffic Code and of the Bureau of Motor Vehicles of the State. Any license obtained by an applicant shall be permanently displayed in his or her place of business and the sticker obtained shall be permanently displayed upon every vehicle hauling refuse, garbage, rubbish or solid waste which is used or parked in the Village.
   (c)    Every motor vehicle used by a licensed hauler to transfer refuse, garbage, rubbish or solid waste in the Village shall have an enclosed, leak-proof body with permanent covers composed of metal, wood or fiberglass and shall be subject to the inspection and approval of the Mayor or his or her designee.
   (d)    Any motor vehicle used by a licensed hauler to transport refuse, garbage, rubbish or solid waste shall not be parked in any residentially zoned district or upon any public street in the Village between one-half hour after sunset and one-half hour after sunrise. No hauler or other person shall park or permit to be parked overnight a motor vehicle or trailer partially or fully loaded with refuse, garbage, rubbish or solid waste in the Village if the parking of such vehicle creates a nuisance. It shall be a prima-facie nuisance if the following conditions exist at the parking site:
      (1)    Excessively offensive odors affecting neighboring properties;
      (2)    An excessive number of flies creating an unsanitary condition; and
      (3)    General unsanitary conditions which are attracting or are likely to attract rats, rodents or similar animals. Any hauler or other person parking or being permitted to park, overnight, a motor vehicle or trailer fully or partially loaded with refuse, garbage, rubbish or solid waste in the Village, shall secure the express written approval of the parking site by the Mayor or his or her designee.
   (e)    Every motor vehicle which is used to haul refuse, garbage, rubbish or solid waste and which is parked in the Village shall be cleaned daily with a solution or solvent which is acceptable to the Mayor or his or her designee. Each motor vehicle so used shall be subject to inspection by the Mayor or his or her designee at a time which is convenient to both the hauler and the Mayor or his or her designee. Inspections shall be made not less than three times per week, except between May 1 and October 1, when inspections shall be made not less than five times per week. Haulers shall comply with all reasonable orders of the Clerk-Treasurer or the Mayor within a reasonable time.
   (f)    Any hauler desiring to increase his or her rate of transporting refuse, garbage, rubbish or solid waste in the Village shall file such increase with the Clerk-Treasurer or the Mayor setting forth the reasons therefor and the effective date thereof.
