727.05 CLASSIFICATION OF WELLS; BOND; INSURANCE.
   Wells less than 1,000 feet in depth, the products from which are used by residences on the site, shall be deemed Class I wells. All other wells shall be deemed Class II wells.
   (a)    Class I Wells. Class I wells shall comply with the following requirements:
      (1)    Class I wells shall be located a minimum of 500 feet from any structure, unless this requirement is waived by the Mayor due to a hardship, but under no circumstances shall such a well be less than 100 feet from any structure.
      (2)    All equipment and the wellhead shall be secured.
      (3)    All emergency access shall be provided in a manner approved by the Fire Chief.

      (4)    A performance bond or cash in the amount of five thousand dollars ($5,000) shall be deposited with the Village prior to the start of any work on the site. Such deposit shall ensure restoration of the roads and rights of way to their original condition after drilling, and may be released by the Village upon determination of compliance or after sixty days, whichever time is longer.

      (5)    The driller or producer shall submit to the Village, prior to commencing drilling operations, evidence of a comprehensive liability insurance policy in the amount of one million dollars ($1,000,000). The terms of such policy shall provide for continuous coverage against both bodily injury and property damage until all drilling and construction have been completed and shall be subject to the approval of the Village
   (b)   Class II Wells. Class II wells shall comply with the following requirements:
      (1)    Class II wells shall be located a minimum of 500 feet from any structure, unless this requirement is waived by the Mayor due to a hardship, but under no circumstances shall such a well be less than 100 feet from any structure.
      (2)    The wellhead and storage tanks shall be securely fenced. The fence shall be of noncombustible material, shall be a minimum of six feet high with barbed wire on top and shall have a locked gate. No structure shall be located within thirty feet of such fence. A minimum ten-foot wide access road capable of supporting eighteen tons and of all-weather composition shall be provided to the tank batteries. In addition, access and equipment shall be maintained during drilling and until the well is in operation.

       (3)    A surety bond in the amount of one hundred thousand dollars ($100,000) shall be deposited with the Village prior to the start of any work on the site. Such bond shall ensure restoration of the roads and rights of way to their original condition after drilling, and may be released by the Village upon determination of compliance (Ord. O-08-030.
