5-2-4: REMOVAL OF PROHIBITED SPECIES:
The Village may not damage, remove, burn or cut vegetation of any property owner for which the Village does not have management responsibilities, except those species set forth in the definition of weeds in section 5-2-2 of this chapter; and turf grass at a height exceeding eight inches (8") as set forth in subsection 5-2-3B of this chapter; provided, however, that the Village Forester or his representative shall provide written notice to the property owner of the existence of prohibited species and/or turf grass exceeding eight inches (8"), directing the property owner to remove same within ten (10) days following such notice and with said removal to be done under the direction of the Village Forester or his representative.
   A.   The notice shall also notify the property owner that unless such prohibited species or turf grass is removed in compliance with the terms herein within said ten (10) day period, the Village will proceed with the removal of said prohibited species or turf grass and assess the costs thereof against the property owner.
   B.   The Village may file a notice of lien for the cost and expense thereof incurred by the Village within sixty (60) days in accordance with state law and enforce said lien pursuant to state law.
   C.   Service of such notice shall be by personal service where the owner of said premises is a resident of the Village; where the owner is a nonresident of the Village, said notice shall be served by certified mail, return receipt requested, addressed to the person to whom was sent the tax bill for general taxes for the last preceding year on the property. Notice shall also be sent by regular mail to the person in possession of the property. (Ord. 917, 3-31-2003)
