(a) Construction or property improvements commencing on or after September 1, 2008: immediate compliance is required.
(b) Construction or property improvements in existence prior to September 1, 2008: 360 days following the completion of construction of the Village separated sewer system when located in the public right-of-way adjacent to said property, or immediately across the street or alley right-of-way from said property. The Village shall notify the property owner(s) when construction is completed in their area and the deadline for compliance. Failure on the part of the Village to provide reasonable notice shall not be a reason for noncompliance.
(c) Construction or property improvements in existence prior to September 1, 2008 in an area not served, or planned to be served by the Village storm sewer system: 360 days following the effective date of this legislation. The Village shall identify and notify all affected property owners of the deadline for compliance within a reasonable time period following enactment of this legislation. Failure on the part of the Village to provide reasonable notice shall not be a reason for non- compliance. (Ord. 08-25. Passed 7-1-08.)
