(A) In accordance with VA Code § 15.2-2242(1), an exception or variation in the requirements of this Subchapter (NCC § 156.001, et seq.) may be granted by the Board of Supervisors upon a showing by clear and convincing evidence that strict adherence to such requirements would result in substantial injustice or hardship.
