§ 34.107 DOUBT AS TO PROPER PAYEE.
   If the Plan Administrator determines that there is doubt as to the proper construction of the plan with respect to determining the beneficiary(s) or other proper payee(s) under the plan, the Plan Administrator shall construe the plan to state provisions consistent with the Uniform Probate Code applied as though the interest under the plan were an interest to a commercial annuity contract, to the extent that any such construction is not inconsistent with any requirement of I.R.C. § 457(b).
