§ 35.041 RESTITUTION AND RESTORATION.
   In addition to (and not by limitation upon) any other remedy, including (but not limited to) any legal, equitable, remedial or other relief, to the extent that any person breaches § 30.021, such person shall be personally liable to make good to the plan (or, in an appropriate case, to the applicable participant or beneficiary or alternate payee) any losses to the plan resulting from or arising out of each such breach, and to restore to the plan any profits of such person which have been made through the breaching person’s improper use of plan assets.
