(A) A site plan review is required whenever a person, firm, corporation or other group wishes to develop any tract(s) or parcel(s) of land within all zoning districts in accordance with the requirements listed below. All projects shall provide an erosion control plan as part of the building permit application process.
(1) New multi-family, commercial and industrial development on one acre or more.
(a) A complete site plan providing all information required by § 155.26 is required for projects located on properties one acre in size or more when the development adds 12,000 square feet or more of building footprint or new paving. Cumulative smaller additions or paving individually less than 12,000 square feet and constructed after November 1, 2015 that aggregate exceed 12,000 square feet will be required to have a complete site plan.
(b) Projects located on properties one acre in size or more and adding 2,000 square feet or more of new building footprint or new paving, but less than 12,000 square feet shall provide a basic site plan. A basic site plan shall contain information required by § 155.26, except for the submittal of the grading plan, drainage and erosion control plan, storm-water detention plan, and drainage report unless one acre of land is disturbed. Cumulative smaller additions or paving individually less than 2,000 square feet and constructed after November 1, 2015 that aggregate exceed 2,000 square feet will be required to have a basic site plan.
(2) New multi-family, commercial and industrial development on under one acre. Projects located on properties under one acre in size and adding 2,000 square feet of new building footprint or new paving shall provide a basic site plan containing information required by § 155.26, except for the submittal of the grading plan, drainage and erosion control plan, storm-water detention plan, and drainage report. Cumulative smaller additions or paving individually less than 2,000 square feet and constructed after November 1, 2015 that aggregate exceed 2,000 square feet will be required to have a basic site plan.
(3) Two or more new single family/duplex construction.
(a) A complete site plan providing all information required by § 155.26 is required when, within a two-year period, a common owner develops two or more abutting lots that are connected by virtue of common, continuous ownership, unless the preliminary plat for the subdivision included a grading, drainage and erosion control, and storm-water detention plans and that the subdivision has been constructed and maintained as approved.
(b) Example of continuous common ownership: the owner of Lots 1, 2, and 3 develops only Lots 1 and 3. A site plan is required due to the continuous, common ownership that exists even though Lot 2 is not being immediately developed.
(4) Interior or exterior modifications or change in use for an existing building. A basic site plan shall be provided for projects where interior or exterior modifications or a change in use for an existing building impact on-site traffic circulation patterns or parking requirements. A basic site plan shall contain information required by § 155.26, except for the submittal of the grading plan, drainage and erosion control plan, storm-water detention plan and drainage report.
(5) Site plan requirement exemptions. Projects which are exempted from site plan requirements:
(a) Agriculturally zoned property when one residence or an agricultural building being developed;
(b) Developments permitted by conditional use permit, unless completion of a site plan is stipulated as a condition of the conditional use permit;
(c) New construction or additions to multi-family, commercial or industrial buildings or new hard surface less than 2,000 square feet;
(d) Interior and exterior modifications to an existing property including a change in use which does not affect nor change the foot print of the building or parking requirements as specified in the city’s Zoning Ordinance.
(6) Temporary structure or tent sales with a total footprint (structure/tent and required additional parking) in excess of 360 square feet, that do not impact on-site parking or circulation patterns, and are erected for more than 20 days. A basic site plan consisting of all information required by § 155.26 except for the submittal of the grading plan, drainage and erosion control plan, storm water detention plan and drainage report, and existing topography of the site.
(a) Fireworks related businesses. Shall show on their site plan the distances from the fireworks sales or warehousing/storage structure to any residences or fuel sources within 200 feet. Applicants shall verify distance from the next nearest fireworks related business.
(b) Previously approved site plans which included a layout for seasonal outdoor sales are exempted from this requirement.
(B) The requirements of this chapter shall not be applicable to existing developments for which building permits have been granted at the time of the enactment of this chapter; provided that, if such building permit expires prior to the completion of the development for which it was issued, a new building permit shall not be issued until the requirements of this chapter have been met.
