(A) Penalties for failure to abide by the requirements of this chapter shall be as follows.
(1) (a) The first violation of this chapter shall be a written warning to cease and desist in the use of water contrary to the provisions of this chapter. The written warning shall contain the penalties stated below for the customer’s reference.
(b) Failure to cease and desist in the use of water contrary to the provisions of this chapter shall result in a civil penalty of $50 for the first violation.
(2) A second violation of the provisions of this chapter shall result in a civil penalty of $250 for the second violation.
(3) A third violation of this chapter shall result in a $500 civil penalty and the immediate termination of water service for a minimum period of 24 hours, or longer if the conditions that caused the violation continue.
(4) A fourth violation of this chapter shall result in a $1,000 civil penalty and the immediate termination of water service until the water shortage condition has been abated.
(B) Nothing in this chapter shall prevent the penalties listed above from being applied in succession on the same or subsequent days if the customer does not abate the violation condition. In an emergency condition, the Utilities Director shall have the ability to order the termination of any water service or use thereof that could cause the town water system to violate state or federal rules and or regulations.
