§ 53.09 VARIANCES.
   (A)   Any water use customer may apply in writing to the Town Manager for a variance to these restrictions. The Utilities Director, after consulting with the Town Manager, may issue a variance to the restrictions if the conditions warrant the variance.
   (B)   Each variance request shall be investigated by the Utilities Director on a case by case basis.
   (C)   If a variance is warranted, the Utilities Director shall issue a written permit for the variance. The permit shall contain specific conditions for the customer to use water that would be prohibited under the water restriction level. Such water use permits shall only be valid until the water use restrictions have ended or the current emergency has been abated.
   (D)   Examples of conditions that warrant an exemption from water use restrictions include, but are not limited to, the following:
      (1)   The operation and maintenance of medical equipment;
      (2)   Heating and cooling systems in medical facilities; and
      (3)   Any condition that would directly effect the health of a person.
