§ 51.053 TAP AND IMPACT FEES.
   (A)   The town shall charge the applicant a sewer tap fee as stated in the town’s fee schedule for which the town will provide the sewer tap from the town right-of-way line to the sanitary sewer main. The owner shall be responsible for installation of the building sewer on the owner’s property to the town’s right-of-way including the connection to the tap provided by the town. The connection of the building sewer to the town tap shall be inspected and approved by the Utilities Director prior to the owner’s covering the connections.
   (B)   Impact fees shall be charged to offset the costs of wastewater treatment capacity improvements such as pump stations, sewer main capacity and the sewage treatment plant.
   (C)   Impact fees shall apply to:
      (1)   All new construction connected to the town’s sewer system;
      (2)   New connections of existing buildings or other improvements not previously connected to the town’s sewer system;
      (3)   Improvements, additions or changes in existing buildings or other improvements requiring increased capacity or increased use of sewer from the town; and
      (4)   New construction that replaces existing structures shall have an impact fee based upon the increased capacity or increased use of sewer from the town.
   (D)   Impact fees will not be charged on buildings or other improvements constructed or made to repair or replace like buildings or improvements damaged or destroyed by fire or other disaster; provided however, that the repair or replacement will not result in any increased capacity requirements over that required to serve the damaged or destroyed buildings or improvements. The decision of the Town Manager as to such increased capacity requirement shall be final.
   (E)   All of the required impact fees shall be paid prior to the issuance of any building permits for the project.
   (F)   Additions or alterations to existing office, commercial or industrial buildings shall be required to pay an impact fee based on the same rates that apply to new construction. The rates may be calculated using the increased average daily flow created by the building addition or change of use. The full payment of the impact fee for this section shall be paid to the town upon issuing the building permit.
   (G)   The impact fee shall be as stated in the town’s fee schedule.
