Any settlement of the trench or its wearing surface during a period of two years after the permanent restoration shall be considered conclusive evidence of defective backfilling by the permittee, and the permittee agrees, in accepting and acting under the permit, that he will make good any such settlement and replace the wearing surface during the period of two years after the
completion of the trench restoration.
