The Street Commissioner, or by a designee, shall assess the cost of removing obstructions from streets, roads, or alleys against the owner or occupant, neglecting to perform their duty imposed by the provisions of this article.
The Street Commissioner shall serve upon such owner or occupant a written notice stating that at the time and place specified therein, they or their agent will assess such costs against the owner or occupant neglecting to perform such duty. Such notice shall be served at least ten days prior to the time specified therein. At the time and place specified, they shall hear the parties interested and shall thereupon complete the assessment, stating therein the name of the owner or occupant, the amount assessed against them, and shall return such assessment to the City Council. Such assessment shall be made a matter or record by the City Council, and the amount so assessed and fixed shall constitute a lien upon the property of such person. The amount so assessed, fixed and levied may be placed in the hands of the sheriff of the county and shall be collected by him, and shall be paid into the general fund, and redistributed to reimburse the fund from which such costs were defrayed.
