129.01  CREATED; GOVERNING BOARD; EMINENT DOMAIN; LEGAL COUNSEL.
   (a)   The City hereby creates and establishes the City of New Martinsville Municipal Building Commission, hereinafter referred to as the “commission.”
   (b)   All powers, property and duties and the management and control of the commission shall be vested in a Board consisting of not less than three nor more than five members.
   (c)   The initial appointees of the Board, each of whom is found to be a resident of the City, shall be the following individuals, with terms to expire on January 1 in the years indicated:

   (d)   Upon the expiration of the term of any initial appointee, the successor thereto shall be appointed for a term of five years.
   (e)   The City finds that not more than two-thirds of the initial appointees of the Board of the Municipal Building Commission are of the same political party and that no member of such board holds any office (other than the office of notary public) or employment with the United States of America, the state, any county or political subdivision of the state or any political party.  No member of the board shall receive any compensation for his services as such, but each member shall be reimbursed by the commission for any reasonable and necessary expenses actually incurred in the discharge of his duties as a member of such board.
   (f)   The Commission may exercise the power of eminent domain in the manner provided in Chapter 54 of the Code of West Virginia without limitation or conditions.
   (g)   The City Attorney shall act as legal counsel to the Commission.
