1301.02  DEFINITIONS.
   (a)   Generally.  For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
      (1)   Alley or service drive.  A passage or way affording generally a secondary means of vehicular access to abutting properties and not intended for general traffic circulation.
      (2)   City Engineer.  The City Engineer of the City of New Martinsville.
      (3)   Commission.  The City Planning Commission.
      (4)   Department heads.  Department heads of the City.
      (5)   Highways, thoroughfares and parkways.  The highways, thoroughfares or parkways so designated on the thoroughfare plan.
      (6)   Local street or collector street.  A street intended to serve and to provide access to neighborhoods or sub-neighborhoods.
      (7)   Minor street.  Any street not a highway, primary or secondary thoroughfare, parkway or local or collector street, and intended to serve and to provide access exclusively to the properties abutting thereon.
      (8)   Park and playground plan.  The plan of parks, playgrounds or other open public grounds adopted by the City Planning Commission.
      (9)   Subdivision.
         A.   The division of any parcel of land, shown as a unit or as contiguous units on the last preceding tax roll, into two or more parcels, sites or lots, any one of which is less than ten acres, for the purpose, whether immediate or future, of transfer of ownership; provided, that the division of partition of land for agricultural purposes into parcels of more than ten acres, not involving any new streets or easements of access, shall be exempted; provided, further that the following shall not constitute a subdivision:  Transfer of interests by will or pursuant to court order; leases for a term not to exceed ten years; mortgages or easements; and the sale or exchange of parcels of land between owners of adjoining property, if additional lots are not thereby created and the lots resulting are not reduced below minimum sizes required by law; or
         B.   The improvement of one or more parcels of land for residential, commercial or industrial structures or groups of structures, involving the division or allocation of land for the opening, widening or extension of any street or streets, except private street serving industrial structures, the division or allocation of land as open spaces for common use by owners, occupants or leaseholders or as easements for the extension and maintenance of public sewer, water, storm drainage or other public facilities.
      (10)   Thoroughfare plan.  The official plan of highways, primary and secondary thoroughfares and parkways.
   (b)   Other Pertinent Terms.  Certain words and phrases not defined in this section shall have the meanings ascribed to them in the Zoning Ordinance (when adopted) of the City.
