(a) Any applicant aggrieved by the action of the Commission in any case under this article may appeal the decision and order of the Commission to Council, which shall hear such appeal de novo; provided, that the applicant/appellant shall, at such time as the applicant shall inform the City Recorder of his intention to perfect such appeal, file with the City Recorder an additional cash bond in the sum of five hundred dollars; provided, further, that the de novo proceeding to be had before Council in connection with such appeal shall be governed by the procedural rules pertaining to hearings before the Planning Commission as specified in subsections (b), (c) and (d) of Section 909.03.
(b) Any applicant/appellant aggrieved by the action of Council in any such case may seek review thereof in the circuit court of Wetzel County as provided in the Code of West Virginia.
