(a) Definitions. For purposes of this Section:
(1) “Golf cart” means a motor vehicle that has not less than three wheels in contact with the ground, that has an unladen weight of less than one thousand eight hundred pounds, that is designed to be and is operated at not more than twenty-five miles per hour and that is designed to carry not more than four persons including the driver.
(2) “Utility vehicle” means a self-propelled vehicle designed with a bed, principally for the purpose of transporting material or cargo in connection with construction, agricultural, forestry, grounds, maintenance, lawn and garden, materials handling, or similar activities.
(3) “Off-street vehicle” means a golf cart or a utility vehicle.
(b) No person shall operate an off-street vehicle on the streets within the Village of New London unless it has been inspected and approved by the Chief of Police, or his designee or by another agent designated by the State of Ohio, for compliance with the applicable safety/equipment requirements of the State of Ohio, relative to motor vehicles.
(c) The owner or operator of any off-street vehicle shall be required to pay a fee in the amount of ten dollars ($10.00) in connection with inspection through the Village Police Department. The Police Department will provide the applicant with evidence acceptable to the State of Ohio Bureau of Motor Vehicles when an off-street vehicle cart passes such inspection.
(d) No person shall operate an off-street vehicle on any public roadway where the posted speed for such roadway is greater than 35 MPH, except when crossing such roadway is required to comply with this section. No person shall operate an off-street vehicle on a public sidewalk or other leisure path.
(e) No person shall operate an off-street vehicle on any public roadway, unless an occupant restraining device is available for each passenger in the off-street vehicle.
(f) Compliance with this section shall be in addition to, rather than in lieu of, any applicable provisions of State law relative to the operation of motor vehicles, including State requirements for title and vehicle registration.
(g) Whoever violates this section is guilty of a minor misdemeanor.
