521.12 UNSAFE STRUCTURES.
   (a)   The Chief of the Fire Department, upon being informed by Council that there exists a dwelling, building or other structure in the Village that is dilapidated, unsafe, dangerous, unhygenic or unsanitary as to constitute a hazard to the health, safety, morals and welfare of the people of the Village, shall make an inspection of such building, dwelling or structure.
   (b)   In the event that the Chief of the Fire Department, upon making such inspection, determines the premises to be in any of the conditions mentioned in subsection (a) hereof, he shall immediately give notice of such determination by certified mail, to the owner or owners of record and to the holders of legal or equitable liens of record upon the real property on which such building is located, at least thirty days to remove or repair such insecure, unsafe or structurally defective buildings or other structures. The notice shall state that if such insecure, unsafe or structurally defective building or other structure is not repaired or removed within the period stated, the same shall be done by the Village under authority of Ohio R.C. 715.26 and 715.26.1
   (c)   In the event that the owner of such insecure, unsafe or structurally defective building or other structure fails to comply with the order of the Fire Chief within thirty days of the notice, the Fire Chief, at the end of such period, shall notify Council of such failure.
   (d)   Upon the receipt of such failure to comply with the order of the Fire Chief by the owner of such insecure, unsafe or structurally defective building, or other structure, Council shall declare such structure a nuisance and order its abatement without any provision for a hearing on the question of a nuisance in accordance with Ohio R.C. 715.26 and 715.26.1.
   (e)   If the Chief of the Fire Department declares that the condition of the building in subsection (b) hereof constitutes an emergency and creates a substantial present risk to the health and safety of the community, he shall so report to Council. Council may, upon receiving such report of the Fire Chief, order said building repaired or removed, forthwith, provided that notice is sent to the persons designated in subsection (b) hereof, notifying them of the intended action of Council.
   (f)   Whoever violates this section is guilty of a minor misdemeanor.
