(a) All businesses located within the City shall henceforth be required to maintain a dumpster on their premises, unless a waiver is granted by Council as described herein.
(b) All businesses located within the City shall henceforth be required to maintain garbage removal service, unless a waiver is granted by Council as described herein.
(c) Any business seeking an exemption from this article may apply to Council for a waiver, which shall be presented to Council at a regular session and voted upon. A waiver shall be granted in the event that a majority of Council votes in favor of the waiver.
(d) It shall hereafter be unlawful for any business not obtaining a waiver as set forth in the foregoing section to operate a business within the City without a dumpster and garbage service.
(e) Failure to comply with this article shall empower the City to withhold a City business license from a violator.
(f) Any person, corporation or other entity found to have violated any of the provisions of subsections (a) through (e) hereof shall be liable to the City for a fine in the following amount(s):
(1) First offense: Twenty-five dollars ($25.00).
(2) Second offense: Fifty dollars ($50.00).
(3) Third or greater offense: Two hundred fifty dollars ($250.00).
(g) The City Court shall have jurisdiction to adjudicate violations of this article.
