(a) No person under the age of eighteen years shall be present, remain, tarry, idle, wander, stroll, or play in or upon the public streets, highways, roads, alleys, sidewalks, parks, playgrounds, or other public grounds, public buildings, vacant lots, unoccupied or derelict buildings, or any unsupervised place, or in any automobile, conveyance, or vehicle between the hours of 10:00 p.m. and 5:00 a.m. of the day immediately following, unless accompanied by his or her parent, guardian or other adult person having written or court ordered care and custody of such minor person, or unless such minor person was returning directly home from night classes, library study, athletic contests, school affiliated dances, or other activities, church functions, the theater, employment, or unless such minor person was upon an emergency errand directed by his or her parent, guardian or other adult person having written or court ordered care and custody of the minor person, and has in his or her possession a written statement dated that day by such parent, guardian or other adult person, and declaring that such minor person is upon an emergency errand.
(b) The City Court may assume jurisdiction of any minor person charged with a violation of this section; and, in such event, the City Court may make any disposition of such charge which could be made by the Circuit Court of Hancock County while exercising its jurisdiction as a Juvenile Court, except that the City shall not have jurisdiction to impose a sentence of confinement for the violation of this section.
