This Release of Maintenance Bond (the “Release”) is hereby presented by the Town Council of the Town of New Carlisle, St. Joseph County, Indiana (the “Council”) to , (the “Principal”), and , (the “Surety Company”) as of this _________day of____________,_______.
WHEREAS, Principal and Surety Company have posted a Maintenance Bond for the maintenance of improvements, installations and lot improvements (the “Improvements”) required by the St. Joseph County Subdivision Control Ordinance (the “Subdivision Control Ordinance”), other applicable Ordinances of Town of New Carlisle (the “town”), and the Council for the subdivision known as (the “Subdivision”); and
WHEREAS, the Bond is applicable to following Improvements [Check all items to be covered by this Release]:

curbs | sidewalks | ||
sanitary sewer | water system | ||
storm drainage & retention | lot drainage | ||

WHEREAS, the Improvements have been maintained at Principal’s own expense for a period of 3 years after the date on which said Improvements were accepted for public maintenance by the town.
