(A) It is not within the powers or jurisdiction of the Board of Zoning Appeals to grant waivers of any of the regulations in this chapter. Only the Area Plan Commission shall have the authority to waive any of the regulations in this chapter.
(B) It is not within the powers or jurisdiction of the Area Plan Commission to grant a variance of development standards or to approve a special exception use. Only the Board of Zoning Appeals shall have the authority to grant a variance of development standards. Only the Town Council shall have the authority to approve a special exception use.
