§ 151.078 SIDEWALKS.
   (A)   Sidewalk location. Sidewalks shall be located along each side of a street within the dedicated, non-paved portion of the street right-of-way.
   (B)   Pedestrian/bike path alternative. Under circumstances considered appropriate by the Area Plan Commission, an alternative pedestrian/bike path may be proposed in lieu of sidewalks. Pedestrian/bike paths shall be a minimum of 8 feet in width to a maximum of 18 feet in width and may be located in easements reserved for that use outside of the street right-of-way. The developer must build the path either in concrete or asphalt construction at the time streets are built.
   (C)   Sidewalk and pedestrian/bike path standards.  
      (1)   Sidewalks shall be constructed in compliance with the town standards.
      (2)   Pedestrian/bike paths may be constructed of concrete, asphalt, or other material approved by the Area Plan Commission and installed in compliance with the requirements specified by the town.
   (D)   Pedestrian access easements. In order to facilitate pedestrian access from streets to schools, parks, playgrounds, or other nearby streets, the Area Plan Commission may require perpetual, unobstructed pedestrian access easements at least 15 feet in width. These pedestrian access easements shall be indicated on the secondary plat.
