§ 151.055 PLAT PROCEDURES; INTRODUCTION AND INTENT.
   (A)   The subdivision process is intended to assure that all platted lots created for sale: are buildable lots that comply with the standards set forth in the Zoning Ordinance and the Subdivision Control Ordinance; and are provided with all the services and utilities required for initial development and the continued use and enjoyment of the lot by the owner. To accomplish this purpose, a drawing of the proposed subdivision, known as a plat, is submitted for review and approval. The review and approval process takes place on 2 levels: a primary plat approval, and a secondary plat approval. The primary plat review is where the overall concept of a proposed subdivision is reviewed for its ability to comply with all zoning, subdivision, and other regulations applicable to development (including but not limited to erosion control, sanitary sewer, potable water, storm sewer, and street standards). The secondary plat review is where the specific details of the subdivision are approved and authorized for recording so that the sale of a buildable lot may legally occur. The procedures contained in this subchapter describe how the plat drawings are prepared and reviewed.
   (B)   Within the primary plat process, depending on the nature and complexity of the proposed development, a subdivision may be classified as either a minor subdivision or a major subdivision. A minor subdivision is a division of land into a very limited number of lots where there is no need for the extension of streets or utilities. A major subdivision involves a larger number of lots, street or utility extensions. Primary plats may also include re-plats as described below. See §§ 151.125 and 151.126 for a more detailed explanation of each type of primary plat.
   (C)   Secondary plats may be approved for recording in 1 of 2 ways: complete all the improvements necessary to provide buildable, serviced lots in accordance with approved construction plans, demonstrate compliance with all conditions imposed on the primary plat by the Area Plan Commission and provide a bond for their maintenance prior to final approval and recording; or provide performance bonds to assure the completion of all construction activities necessary to provide buildable, serviced lots in accordance with approved construction plans and demonstrate compliance with all conditions imposed on the primary plat by the Area Plan Commission. The performance bonds will be replaced with maintenance bonds as individual construction elements or phases are completed. Secondary plats may also include corrective plats as described below.
