(A) It shall be the duty of the Town Marshal to make an inspection of all lots, tracts, parcels of land, or other real estate in the town, on or before July 15 of each year, or as soon thereafter as he or she may be able so to do.
(B) Whenever it is found that any person owning, leasing, or controlling any lots, tracts, parcels of land, or other real estate has permitted the same to become overgrown with weeds, thistles, underbrush, or rank vegetation, it shall be the duty of the Clerk-Treasurer to notify the owners, lessees, or managers of the real estate to remove the weeds, underbrush, or rank vegetation within 10 days.
(C) In the event that the real estate is owned by nonresidents, then notice shall be served upon their agent, or agents, if any, and if there be none, by mailing the notice to the last known address of the person owning the real estate.
(D) Notice shall be given pursuant to I.C. 36-7-11.2-11.
(E) Upon failure of any person to comply with the order and notice of the Clerk-Treasurer within the designated time, then the Clerk-Treasurer shall proceed to cause the weeds, brush, undergrowth, or rank vegetation growing on the real estate to be removed, and the cost, charges, and expenses shall be collected as taxes are collected and shall be disbursed to the General Fund of the town.
