§ 91.26 APPLICATION AND PERMIT.
   (A)   Any person who desires to excavate into, under, and along a public street or alley in the town shall first make application in writing to the Town Council, designating in the application the purpose for which the excavation is to be made, the size and number of excavations and other information as the Council shall require and stating therein that all the terms and conditions of this subchapter will be complied with, in making the excavation and the repairs of the surfaces or pavements on the street or alley. The Council shall make recommendations to the Clerk-Treasurer of the town accordingly.
   (B)   Upon compliance with this section, and upon the permit being approved by the Council, the Clerk-Treasurer shall issue a permit.
   (C)   The Town Council may designate the Town Engineer as its agent and representative, who may review and approve permit applications as the town may receive; provided, however, that official action of the Council shall be required in the event that it is the best interests of the town to grant a waiver or a variance of the requirements contained herein.
