(a) No person, except in the case of fire, or unless duly authorized by the Fire Chief and the Building Department, shall open, tamper or use water from any fire hydrant.
(b) In order for any party other than the Village or the Cleveland Water Department to use a fire hydrant located within the Village, a permit must first be obtained. A party must submit an application for use of a fire hydrant to the Village Building Department. Prior to the issuance of any permit hereunder, said application must be reviewed and approved by the Village Fire Chief. If approved by the Fire Chief, a permit will be issued under the terms and conditions set forth in subsection (c) and any other terms or conditions as established by either the Fire Chief or the Building Commissioner. Any terms, conditions or procedures established by the Fire Chief or the Building Department shall be kept on file with the Village Building Department.
(c) Applicant shall pay a fifty dollar ($50.00) non-refundable application processing and handling fee which shall accompany each application for a fire hydrant use permit. In connection with the use of any fire hydrant, each applicant shall be responsible for:
(1) Payment of any damage suffered by the Village and/or
(2) Satisfaction of any claims made against the Village by any party, in connection with the use of any fire hydrant by the applicant or the applicant's representatives, agents, employees or servants, including, but not limited to, actual costs for water usage.
There shall be no cap on the liability of applicant or applicant's representatives, agents, employees or servants for any costs, expenses or damages incurred through the use of the fire hydrant. Any permit issued hereunder shall be non-assignable.
