521.13 GRILLS IN MULTI-UNIT STRUCTURES.
   (a)   No person being the owner or occupant of a unit in a residential structure having two or more units including but not limited to apartments, condominiums, boarding houses and similar shelters shall use a bar-b-que grill, hibachi, or any other device or appliance producing an open flame for the purpose of cooking on any balcony, porch or roof top located above the grade level of any such structure.
   (b)   No person being the owner or occupant of any structure or unit described in subsection (a) hereof shall store propane tanks for bar-b-que grills in the interior areas within any unit of such structures.
   (c)   Persons being owners or occupants of a unit or structure defined in subsection (a) hereof may use open-flame cooking bar-b-que grills, hibachis or any other device or appliance on open patio areas at grade level provided there shall be a minimum horizontal distance of six feet from the nearest balcony or overhanging appendage.
   (d)   Whoever violates this chapter is guilty of a minor misdemeanor for a first offense and a misdemeanor of the fourth degree for each subsequent offense.
