(a) No person shall operate, engage or set in motion, any electric or gas powered machinery or equipment which creates a noise that can clearly be heard from a distance in excess of fifty feet before 7:00 a.m. and after 9:00 p.m. during weekdays and before 8:00 a.m. and after 9:00 p.m. on weekends and holidays.
(b) It is an affirmative defense to a charge under this section that operation of such machinery or equipment creating the excessive noise during the prohibited hours was necessary due to an emergency.
(c) Whoever violates this section shall be guilty of a minor misdemeanor punishable by a fine up to one hundred dollars ($100.00).
