(a) Waste containers and waste or refuse not placed in containers shall not be placed in front of any house or other building by the owner, agent, lessee or occupant of that building for collection prior to 6:00 p.m. on the evening immediately preceding the day for refuse collection.
(b) Empty waste containers shall not be permitted to remain in the front of any house or other building by the owner, agent, lessee or occupant of that building for a period in excess of twelve hours from the time of collection by the City.

(c) Whoever violates any provision of this section shall be subject to the following schedule of fines and penalties:
(1) Fifty dollars ($50.00) fine upon a first offense;
(2) One hundred dollars ($100.00) fine upon a second offense that occurs within twelve (12) months of the first offense;
(3) Two hundred fifty dollars ($250.00) fine upon a third offense that occurs within twelve (12) months of the second offense; and
(4) Two hundred fifty dollars ($250.00) fine and 1st degree misdemeanor charge for a fourth offense that occurs within twelve (12) months of the third offense.
