905.05 STATIONING OF OFF-DUTY POLICE OFFICERS DURING STREET CONSTRUCTION PROJECTS.
   Any street construction project requiring an application pursuant to Section 905.02 shall comply with the following:
   (a)   If it is determined by the Safety Director, and/or Police Chief that police protection is necessary for the orderly and safe flow of traffic, and for the protection of the general public at any street/highway construction project requiring an application pursuant to Section 905.02 , the contractor(s) performing such construction work shall hire off-duty Newburgh Heights police officer(s) in order to insure such orderly and safe flow of traffic and protection of the general public.
   (b)   If sufficient off-duty Newburgh Heights police officers are not available to provide for the orderly and safe flow of traffic and to provide for the protection of the general public, then the contractor(s), and/or utility company and/or railroad shall hire any other off-duty police or deputy sheriff, provided such police or deputy sheriff has completed 240 hours of police training as required by law.
