(A) Properly licensed mobile food units may park and operate at the following locations during the times designated in division (B) of this section:
(1) Old Lock and Dam Park on State Road 662 a.k.a. French Island Trail using available on-street parking located immediately in front of the Old Lock and Dam Park;
(2) The parking lot of Lou Dennis Community Park;
(3) The town public parking lot located on State Street between Jennings Street and Main Street;
(4) The town public parking lot located at the intersection of State Road 662 and Main Street (the former site of the Newburgh Recycling Center); and
(5) The town public parking lot located the Aurand Trailhead off of State Road 662.
(B) Properly licensed mobile food units may park and operate at the locations designated in division (A) of this section only during the following designated times:
(1) Wednesdays from 5:00 p.m. to 9:00 p.m.;
(2) Saturdays from 8:00 a.m. to 9:00 p.m.; and
(3) Sundays from 10:00 a.m. to 2:00 p.m.
(C) Mobile food unit vendors may not park in the above referenced areas during any approved special events in those areas unless authorized by the organizer of the special event. If approved as part of a special event permit, mobile food units and mobile food vendors may operate at and during the approved special event without a license issued under this chapter.
(D) A properly licensed mobile food unit may park and operate on private commercially zoned property with permission of the property's owner in connection with an established commercial business located on the property.
(E) A license under this chapter shall not be required for a mobile food unit to park and operate on private property for and during a private event where mobile food unit sales are not offered or made to the public. However, such operation is subject to all other applicable laws, regulations and ordinances.
