§ 33.01 ELECTION DISTRICTS.
   (A)   The town shall have four districts, numbered one through four, and one at-large district.
   (B)   The Town Council shall consist of five members who are serving staggered terms pursuant to prior town ordinances, which convention is not modified by this section.
   (C)   All members of the Town Council shall be elected by the voters of the whole town.
   (D)   The Town Council herewith divides the town into the districts as set out in divisions (E) through (I) below for the purpose of conducting the election of town officers.
   (E)   District One is herewith created and shall encompass all of that real estate bounded as follows:
      District I
      Point of beginning on the state boundary line between Indiana and Kentucky at the southwestern corner of the Corporate Limits for the Town of Newburgh; thence north 720 feet, more or less; thence east 1100 feet, more or less; thence north to the south right-of-way of the Evansville and Ohio Valley Railway (abandoned); thence northwesterly 700 feet, more or less, along said right-of-way; thence north to the south right-of-way line of Jennings Street (Old SR 662); thence west along said right-of-way to Ellerbush Road; thence north along the west right-of-way line of Ellerbush Road to the north line of Casey Subdivision extended west; thence east along the north line of said subdivision to a point on the west line of Windsor Pointe Subdivision; thence north 300 feet, more or less, along the west line of said subdivision; thence west 470 feet, more or less, to the west right-of-way line for Ellerbush Road; thence north along said right-of-way line to the north line of Windsor Pointe extended west; thence east along said north line to Maple Lane North Subdivision; thence continue east along said north line to Knob Hill Mobile Home Park; thence continue east 575 feet, more or less, to the northeast corner of Knob Hill Mobile Home Park; thence south 1275 feet, more or less, to a point on the northwest corner of Allen-Prince Subdivision; thence east along the north line of said subdivision to Frame Road; thence south along the centerline of Frame Road to Old State Road 662; thence southeasterly along the centerline of Old State Road 662 to Main Street; thence southeasterly along the centerline of Main Street to Washington Street; thence south along the centerline of Washington Street to Water Street; thence east along the centerline of Water Street to Jefferson Street; thence south along the centerline of Jefferson Street extended south to a point on the state boundary between Indiana and Kentucky; thence west along said boundary to the point of beginning.
      Including the property owned by Robert B. Grimm, Herbert P. Grimm and Margaret L. Griffin containing 23 acres, more or less, as recorded on Document No. 2005R-014026 in the Office of the Recorder of Warrick County, Indiana, which property is located immediately north of SR 662 and immediately west of Ellerbusch Road.
   (F)   District Two is herewith created and shall encompass all of that real estate bounded as follows:
      District II
      Point of beginning on the state boundary line between Indiana and Kentucky at the intersection with State Street extended south, point also being on the south Corporate Limits line for the Town of Newburgh; thence west along the said state boundary and Corporate Limits line to the intersection with Jefferson Street extended south; thence north along the centerline of Jefferson Street to Water Street; thence west along the centerline of Water Street to Washington Street; thence north along the centerline of Washington Street to Main Street; thence west along the centerline of Main Street to Jennings Street; thence west along the centerline of Jennings Street to Frame Road; thence north along the centerline of Frame Road to the north line of Newburgh Village Subdivision; thence east 860 feet, more or less, along the north line of said subdivision to a point on the west line of Jefferson Park Subdivision; thence north 770 feet, more or less, along the west line of said subdivision; thence east 80 feet, more or less, along said subdivision boundary; thence north 475 feet, more or less, along the west line of said subdivision; thence west 950 feet, more or less, along the southern boundary of real estate owned by Thomas J. and Kathy S. Merrill as recorded on Document No. 2010R-000916 in the Office of the Recorder of Warrick County, Indiana until reaching the west right-of-way line of Frame Road; thence north along the west right-of-way line of Frame Road 290 feet, more or less, to the northwest boundary of the Merrill real estate; then east along the northern boundary of the Merrill real estate 1310 feet, more or less, to the western boundary of Copper Creek Subdivision; thence north 1860 feet, more or less, along the west line to the northwest corner of said subdivision; thence east 1365 feet, more or less, to the east right-of-way line of Bell Road; thence south 180 feet, more or less, to the northwest corner of real estate owned by the Bishop of the Catholic Diocese of Evansville, Bishop Charles C. Thompson as recorded on Document No. 2011R-007061 in the Office of the Recorder of Warrick County, Indiana; thence east along the northern boundary of such real estate 740 feet, more or less, to the northeast corner of such real estate; thence south along the eastern boundary of such real estate 230 feet, more or less, to the southeast corner of such real estate; thence west along the southern boundary of such real estate 740 feet, more or less, to the east right-of-way line of Bell Road; thence south 1160 feet, more or less, along said right-of-way; thence east along the north line of the Alexander Funeral Home to a point on the west line of State Street (Old SR 261) right-of-way; thence southwest along said right-of-way 40 feet, more or less; thence east 60 feet, more or less, to the east right-of-way line of State Street (Old SR 261) and the northwest corner of Lot 17, Lake Newburgh Subdivision; thence southwest along said right-of-way 1260 feet, more or less, to the intersection with Jefferson Street; thence southwesterly along the centerline of Jefferson Street to Posey Street; thence east along the centerline of Posey Street to Monroe Street; thence north along the centerline of Monroe Street to Gray Street; thence east along the centerline of Gray Street to Sycamore Street; thence south along the centerline of Sycamore Street to the intersection of French Island Trail and Water Street; thence west along the centerline of Water Street to State Street; thence south along the centerline of State Street extended south to the point of beginning.
      Including Lot 17, Lake Newburgh Subdivision.
      Excepting parcels of real estate bounded by Jefferson Park Subdivision on the south and west; Copper Creek Subdivision on the north and Bell Road on the east.
   (G)   District Three is herewith created and shall encompass all of that real estate bounded as follows:
      District III
      Point of beginning at the intersection of Sharon Road and St. Catherine Court; thence south along the centerline of St. Catherine Court to Treelane Drive; thence west along the centerline of Treelane Drive to Hillcrest Drive; thence south along the centerline of Hillcrest Drive to Gray Street; thence west along the centerline of Gray Street to Monroe Street; thence south along the centerline of Monroe Street to Posey Street; thence west along the centerline of Posey Street to Jefferson Street; thence northeast along the centerline of Jefferson Street to State Street (Old SR 261); thence south along the centerline of State Street to a point on the Corporate Limits for the Town of Newburgh and also the northwest corner of real estate owned by Joiko Guido as recorded on Document No. 2001R-011696 in the Office of the Recorder of Warrick County, Indiana; thence east 440 feet, more or less, along north line of said real estate; thence south along east line of said real estate to Sharon Road; thence east along the centerline of Sharon Road to the point of beginning.
   (H)   District Four is herewith created and shall encompass all of that land bounded as follows:
      District IV
      Point of beginning on the state boundary line between Indiana and Kentucky at the intersection with Westervelt Drive extended south, point also being the southeast corner of the Corporate Limits for the Town of Newburgh; thence northwesterly along the said state boundary to the intersection with State Street extended south; thence north along the centerline of State Street to Water Street; thence east along the centerline of Water Street to Sycamore Street; thence north along the centerline of Sycamore Street to Gray Street; thence east along the centerline of Gray Street to Hillcrest Drive; thence north along the centerline of Hillcrest Drive to Treelane Drive; thence east along the centerline of Treelane Drive to St. Catherine Court; thence north along the centerline of St. Catherine Court to Sharon Road; thence east along the centerline of Sharon Road to the northeast corner of said Corporate Limits and the east line of Forrest Park Subdivision; thence south along east line to the southeast corner of said subdivision; thence west along south line of said subdivision to the northeast corner of C.C. Wade Subdivision; thence south along east line of said subdivision to the intersection of Outer Gray Street and Westervelt Drive; thence south along said centerline of Westervelt Drive to the point of beginning.
      District IV shall also include the property owned by the Town of Newburgh Department of Parks and Recreation consisting of 10.61 acres and identified as Parcel No. 87-13-30-100-001.000-014 that is located at the northeast comer of the intersection of Anderson Road and Lincoln Avenue, also known as AMAX Field, and the property owned by the Town of Newburgh consisting of 13.42 acres and identified as Parcel No. 87-16-06-200-001.000-014 having a street address of 6344 S. Vanada Road, also known as the Leon Key Wastewater Treatment Facility. These two parcels of land currently have no people residing in them and are not expected to have people residing in them.
   (I)   The At-Large District is herewith created and encompasses all real estate in the town.
   (J)   The members of the Town Council representing Districts One, Two, Three and Four shall reside in the district from which such Councilperson ran for election and was elected as the representative. The At-Large District Councilperson may reside anywhere in the town limits.
   (K)   The Clerk-Treasurer may reside anywhere in the town and shall be elected by the voters of the whole town.
