§ 31.04 COMMISSIONSHIPS.
   (A)   At the first meeting of the Town Council of each calendar year, members of the Town Council shall be elected by majority vote of the Town Council to each of the following positions:
      (1)   Street Commissioner;
      (2)   Sewer Commissioner;
      (3)   Police Commissioner;
      (4)   Fire Commissioner;
      (5)   Parks Commissioner;
      (6)   Land Use Commissioner; and
      (7)   Air Board Commissioner.
   (B)   Commissioners of particular departments shall have no independent authority or jurisdiction to act within the department to which he or she is assigned, except as specifically authorized by law or by other ordinance, but said Commissioner shall review, oversee and report on the activities of his or her department. A Councilperson may serve as a Commissioner in not more than two positions.
   (C)   The Park Commissioner shall sit with the Park Board and may participate in the meetings thereof as though a member, but the Park Commissioner shall have no vote on the Park Board.
   (D)   The Land Use Commissioner shall sit with the Plan Commission and with the Board of Zoning Appeals and may participate in meetings thereof as though a member, but shall have no vote thereon as Land Use Commissioner.
   (E)   The Air Board Commissioner shall sit with the Town Airport Board but shall have no vote on such Board.
   (F)   The terms of the appointments of the Commissioners hereinabove outlined shall be for one year, commencing on the second Thursday in January (or other date of appointment) and terminating on the second Thursday in January of the following calendar year (or upon the appointment and qualification of a successor), unless such term is terminated upon a majority vote of the Town Council. In the event that any Council member fails to agree to fill a Commissionship, then the President of the Town Council shall appoint a Commissioner to fulfill the duties of such Commissioner until the position is filled by election by the Town Council.
