(A) No public utility, regulated by the Indiana Utility Regulatory Commission, shall be required to pay street cut permit fees as prescribed by the town’s ordinances so long as said public utility posts the bond required by the town’s ordinances guaranteeing repair of street cuts made by such utility, and so long as such utility gives notice that such street cuts will occur.
(B) The provisions of Ord. 1990-2 shall apply to any noncomplying public utility.
