§ 51.068 ENCROACHMENT AGREEMENT.
   (A)   No encroachment into an easement used or available for use by the town shall be permitted without the approval of the town and the execution of an encroachment agreement by the applicant, which agreement, if approved, shall be recorded in the office of the County Recorder.
   (B)   An application for an encroachment agreement involving sanitary sewers shall be filed with the Sewer Department Office on forms provided by that office together with a non-refundable fee of $50 to cover the cost of review, preparation of the agreement and recordation of the agreement once approved and executed.
   (C)   An application for an encroachment agreement involving any easement or right-of-way other than sanitary sewer shall be filed with the office of the Clerk-Treasurer on forms provided by that office together with a non-refundable fee of $50 to cover the cost of review, preparation of the agreement and recordation of the agreement once approved and executed.
   (D)   The fee payable to the Sewer Department shall be deposited in its General Operating Fund and the fee payable to the Clerk-Treasurer shall be deposited in the General Fund.
