§ 35.041 LOCAL BUSINESS PREFERENCE.
   For purposes of a “local Indiana business” preference claim in public works or public purchasing contracts or quotes the following documentation will be required to substantiate that a firm qualifies as a “local Indiana business”.
   (A)   To establish that a business has its principal place of business in an affected county, the town will accept:
      (1)   Documents reflecting registration with the Indiana Secretary of State listing an affected county as the business’s primary place of business;
      (2)   Documents reflecting registration of the business with a county recorder, listing an affected county as the business’ primary place of business; or
      (3)   Copies of federal or state tax filings evidencing an affected county as the primary place of business.
   (B)   To establish “local Indiana business” status based on a majority of payroll being paid to residents of affected county, the town will require detailed payroll data for the 12 months prior to the bid date.
   (C)   To establish “local Indiana business” status based on a majority of employees being residents of affected counties, the town will require detailed employment data for the 12 months prior to the bid date.
