§ 132.13 CURFEW.
   (A)   Curfew for minors.
      (1)   Subject to the exceptions set forth in division (A)(2) of this section, it shall be unlawful for any person under the age of 18 years to be or remain upon any street, alley, lot, public place, or semi-public place in the village between the hours of 11:00 p.m. and 6:00 a.m. of the succeeding day, Sundays through Thursdays and between the hours of 11:59 p.m. and 6:00 a.m. of the succeeding day on Friday and Saturday nights.
      (2)   Division (A)(1) of this section shall not apply to a minor who is:
            (a)   Accompanied by a parent, guardian, or custodian;
            (b)   Participating in, going to, or returning from lawful employment;
   (B)   It shall be unlawful for any parent, guardian, or other adult person having legal custody of a person under 18 years of age, to allow, or permit such a person under 18 years of age to go or be upon any street, alley, lot, public place, or semi-public place in the village, as restricted in division (A) above, except as provided therein.
   (C)   Upon the first violation of division (A) above, the police shall take the child to his or her home, discuss the provisions of this section with the guardian, parent or custodian and issue a warning citation. Upon a second occurrence by such child, process shall be issued against the child's parent, guardian or custodian and the minor cited to the proper Juvenile Court.
   (D)   Special advance approval to change the curfew hours to a later time, occasioned by attendance of minors at organized public functions, may be granted by the Mayor. All requests for time changes must be made in advance to permit not less than 24 hours' notice of such authorization.
   (E)   Any person under the age of 18 years of age who violates division (A) of this section shall be an unruly child as defined in R.C. § 2151.022 and subject to the penalties of R.C. § 2151.354. Any person who violates division (B) of this section shall be guilty of a misdemeanor of the fourth degree.
