§ 90.27 REMOVAL OF ANIMAL WASTE.
   (A)   Any person owning or having charge of any animal shall be responsible for the removal of any excreta deposited by his or her animal on public walks, recreation areas, public streets or private property immediately after being left by said animal.
   (B)   Any person owning or having charge of any animal shall remove animal waste from his or her own private property within 48 hours of being left by said animal.
   (C)   This section shall not apply to disabled persons accompanied by a service animal used for assistance in accordance with the law.
   (D)   Whoever violates this section shall be fined $50.
      (1)   If the offender has been previously convicted of violation of this section within three years of the date of the current offense, the person shall receive a fine of $100.
      (2)   If the offender has been convicted of two previous offenses of this section within three years of the day of the current offense, the offender shall be fined up to the sum of $500.
      (3)   If the offender has been convicted of more than two previous violations of this section within three years of the date of the current offense, a violation of this section is considered a misdemeanor of the third degree.
