(A) No person shall use an engine retarder on a motor vehicle which will cause that vehicle to emit a loud, crackling or chattering noise unusual to its normal operation.
(B) Whoever violates this section shall be guilty of a minor misdemeanor on the first offense and a fourth degree misdemeanor on a second violation of this section within two years of previous conviction.
