(A) The Village Administrator is hereby authorized and directed to manage and control the waterworks system in the Village in a safe, economical, and efficient manner provided by law.
(B) The Village Administrator is further authorized and directed to make such regulations as may be deemed necessary for the safe, economical, and efficient management and protection of said waterworks system, subject to the laws of the State of Ohio, and the ordinances and resolutions of the Village of New Bremen, Ohio.
(C) Charges for water and water service shall be charged and paid monthly at the same time as charges for wastewater services are paid and shall be included on the same invoice as the charge for wastewater services for the same period.
(D) Definition of classes of uses of the water service of the village:
(1) RESIDENTIAL shall include all single or multiple unit residential accounts inside village corporation limits.
(2) RURAL RESIDENTIAL shall include single residential accounts that are outside the municipal corporation limits and rate shall be 150% of the charges had the user account been located inside said corporation limits.
(3) COMMERCIAL shall include all non-residential accounts.
(4) RURAL COMMERCIAL shall include all non-residential accounts that are outside the municipal corporation limits and rate shall be 150% of the charges had the user account been located inside said corporation limits.
(5) GOVERNMENT shall include non-village of New Bremen government accounts.
(6) RURAL GOVERNMENT shall include non-village of New Bremen government accounts that are outside the municipal corporation limits and rate shall be 150% of the charges had the user account been located inside said corporation limits.
(7) BULK WATER shall include bulk water customers who fill their tanks and/or pools with village water. Hydrant meter rental fee plus water consumption based on water rates. There is no waste water charge.
(8) The Village Administrator shall have the authority to determine the class of each user.

Note 1: For years 2027 and beyond, rates are based on previous year rates plus 4.0%
(F) With the effective date of this passage, all new accounts for multifamily unit structures are required to have its own water tap, meter, and shut off.
(G) Out of corporation users: Effective rates will be charged per month to all current out of corporation users of water. It is hereby declared that based upon the long-term operation of the Village Water System that connections will no longer be allowed to those users outside the corporation limits, unless determined by the County Auditor's Map Department that there is no annexation point and said connection is in the best interest of all parties involved, with said agreement being made between the user and the Village Administrator. The user must hereby agree in writing in said circumstance to annex to the Village of New Bremen, should there ever be a legal annexation point to the serviced property in the future.
(H) (1) The Village Council may review rates each year and adjust at their discretion or by recommendation of Village Administrator.
(2) This may be done by motion and majority vote of Council. The increase will take effect as established by Council.
(I) (1) Nonpayment penalties. A 10% penalty shall be added to all bills not paid by the tenth day of the month in which payment is due. During and after hour disconnect and reconnect fees will apply.
(2) Payment responsibility. For rental and non-owner-occupied properties service billing shall be the responsibility of the tenant. Failure to pay will result in court action. Owners of property may request billing to remain in his/her/its name.
(3) To receive service customer must complete a utility application available at the municipal building.
(4) No deposit is required for owner occupied residential and commercial properties.
(5) A deposit of $250 per account is required before obtaining service for non-owner-occupied residential properties.
(6) A deposit of $500 per account is required before obtaining service for non-owner-occupied commercial prope1ties.
(7) The Village Administrator shall have the authority to determine the class of each user.
(8) Deposit of funds. All funds collected for water service shall be deposited into a separate and distinct fund known as the water fund and said monies shall be used for the payment of costs and expenses incurred for the management, maintenance, enlargement, operation and repair of the waterworks system and for no other purpose.
(J) The village shall implement the following connection/tap charges for the following:
Water Tap/Connection Charge: $350 plus actual cost incurred by the village. Eg: meter and transmitter.
