After the initial registration period provided in § 110.05, each machine must be registered with Newberry County within 3 days of being brought into Newberry County. The machine owner or owner/operator must establish the date that the machine was brought into Newberry County, and the Newberry County Tax Assessor may rely on the records of the South Carolina Tax Commission to establish the date. In the event a video poker machine is brought into, operated, or possessed in Newberry County without being registered, and/or without the license fee being paid within the time period allowed by §§ 110.01 et seq., each day's operation without the machine being registered and/or the license fee being paid and/or permanently affixed to the machine shall constitute a separate offense under §§ 110.01 et seq. and each offense shall be subject to the maximum penalty authorized for offenses within the jurisdiction of the Magistrate's Court. The license fee, and any fines or penalties imposed by a magistrate in a prosecution under §§ 110.01 et seq. shall constitute a lien on the machine, and the machine is subject to sale under §§ 110.01 et seq., to satisfy the lien, but this remedy is cumulative to the obligation of the person charged under §§ 110.01 et seq. to pay the license fee, fine, or penalty.
