§ 130.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   (1)   An individual who violates §§ 130.30 through 130.32 by exhibiting nuisance behavior shall be cited into the Floyd County Court by the Police Department and be assessed the following fines:
         (a)   First offense: $25, plus court costs;
         (b)   Second offense: $50, plus court costs; and
         (c)   Third and subsequent offenses: $100, plus court costs.
      (2)   The Board of Public Works and Safety shall assess the following fines against any owner whose property has been declared a public nuisance pursuant to the provisions of this subchapter:
         (a)   First time property is declared a public nuisance: $50, plus court costs; and
         (b)   Second and all subsequent offenses: $100, plus court costs.
