(A) Effective October 1, 2005, the City of New Albany shall assess a fee of $35 for each vehicle ordered to be towed by the New Albany Police Department, except those vehicles that must be towed as a result of circumstances beyond the control of the vehicle owner (i.e., vehicular accident for which the owner/driver bears no fault).
(B) Effective October 1, 2005, the Police Department shall collect this $35 fee prior to releasing any towed vehicle to the owner and shall forward the collected fees to the Office of the Controller for the City of New Albany a minimum of once per month.
(C) The tow-in companies to be used must provide proper insurance information, will be called on a rotation basis and must be located in Floyd County.
